Terms and Conditions for Zoomzi

1. Introduction

Welcome to Zoomzi, a digital marketplace operated by NerdyIT (Pty) Ltd (“we”, “us”, “our”).

By downloading, registering, or using the Zoomzi mobile app or website, you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree, please stop using the platform immediately.


2. Definitions

  1. “Platform” – Refers to the Zoomzi mobile application and website.
  2. “User” – Any person using the Zoomzi platform, including buyers, sellers, and delivery partners.
  3. “Vendor” – A merchant or business listing products or services on Zoomzi.
  4. “Delivery Partner” – A driver or courier registered to deliver items sold through Zoomzi.
  5. “Customer” – A buyer who places orders through Zoomzi.


3. Use of the Platform

  1. Users must be at least 18 years old to use Zoomzi.
  2. You agree to use the platform only for lawful purposes.
  3. You must not:
  4. Attempt to hack, reverse-engineer, or disrupt the platform’s operation.
  5. Post false, misleading, or harmful content.
  6. Use Zoomzi to conduct fraudulent or illegal transactions.
  7. NerdyIT reserves the right to suspend or terminate any account that violates these Terms.


4. Account Registration

  1. Users must provide accurate and complete information when creating an account.
  2. You are responsible for maintaining the confidentiality of your login details.
  3. NerdyIT is not responsible for any loss resulting from unauthorized access to your account.
  4. We reserve the right to verify account details or request additional documentation.


5. Platform Role and Liability

  1. Zoomzi acts as a facilitator between buyers, vendors, and delivery partners.
  2. NerdyIT does not manufacture, store, or own any of the products listed.
  3. All transactions occur directly between users (vendors, customers, and drivers).
  4. NerdyIT is not liable for:
  5. Product quality, accuracy, or safety.
  6. Delivery delays or failures.
  7. Loss, theft, or damage during transit.
  8. Disputes between vendors, customers, or drivers.
  9. However, NerdyIT may intervene at its discretion to mediate or assist in resolving complaints.


6. Payments and Commissions

  1. Payments made through Zoomzi are processed securely via third-party gateways.
  2. NerdyIT may charge commission or transaction fees on successful orders.
  3. Commission rates and payout cycles are defined within each vendor’s onboarding agreement or app dashboard.
  4. NerdyIT reserves the right to adjust commission rates, with reasonable notice to vendors.
  5. Refunds, chargebacks, or payment disputes will follow our internal dispute resolution process.


7. Delivery Services

  1. Delivery partners operate independently and are not employees of NerdyIT.
  2. Delivery fees are displayed before checkout and may vary by distance or demand.
  3. NerdyIT is not responsible for accidents, delays, or conduct of delivery partners.

8. Vendor Obligations

Vendors agree to:

  1. Provide accurate product information and pricing.
  2. Ensure products comply with all applicable laws and safety standards.
  3. Honor confirmed orders and respond promptly to customer inquiries.
  4. Maintain up-to-date stock and delivery information.

NerdyIT reserves the right to suspend or remove vendors who fail to meet these standards.


9. Content Ownership


  1. All trademarks, logos, text, graphics, and software on Zoomzi are the property of NerdyIT (Pty) Ltd or its licensors.
  2. Users retain ownership of content they upload (e.g., product photos), but grant NerdyIT a non-exclusive, royalty-free license to use, display, and promote such content for marketing purposes.
  3. Unauthorized copying, modification, or distribution of platform materials is prohibited.


10. Marketing and Communications

By using Zoomzi, you agree to receive:

  1. Transactional messages (order confirmations, delivery updates).
  2. Marketing messages (promotions, special offers).

You may unsubscribe from marketing communications at any time, but essential service notifications will continue.


11. Termination

NerdyIT may suspend or permanently delete any user account that:

  1. Violates these Terms,
  2. Engages in fraudulent activities, or
  3. Harms the Zoomzi brand or users.

Users may terminate their accounts at any time via the app or by emailing support@zoomzi.co.za.


12. Limitation of Liability


To the fullest extent permitted by law:

  1. NerdyIT will not be liable for indirect, incidental, or consequential damages arising from the use of Zoomzi.
  2. Our total liability for any claim shall not exceed the total commission or fee earned from the transaction in question.
  3. Zoomzi is provided “as is”, without any warranty of performance or uninterrupted availability.


13. Indemnification

You agree to indemnify and hold harmless NerdyIT, its directors, employees, and partners from any claims, damages, or expenses arising from:

  1. Your use of the platform,
  2. Violation of these Terms, or
  3. Infringement of any rights of a third party.


14. Privacy

Your use of Zoomzi is also governed by our Privacy Policy, which explains how we collect and handle your data.


15. Changes to These Terms

NerdyIT may revise these Terms from time to time. The updated version will be published on zoomzi.co.za/terms with a new effective date. Continued use of Zoomzi after changes means you accept the new Terms.


16. Governing Law


These Terms are governed by the laws of the Kingdom of Eswatini, and any disputes will be handled by competent courts within Eswatini.
